Terms of Service

1. About WaitLessQ

WaitLessQ ("the Service", "the App") is a digital queue and waitlist management application developed and operated by Pazhanam Technologies Pvt Ltd, a company registered in India ("we", "us", "our"). The Service is available as an Android application and via web browser, and is designed for use by restaurants, salons, beauty parlours, barbershops, clinics, and other walk-in businesses.

2. Acceptance of Terms

By creating an account, downloading the app, or using any part of the Service, you confirm that:

• You are at least 18 years of age.
• You have the legal authority to enter into a binding agreement on behalf of yourself or the business you represent.
• You have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Account Registration

To use WaitLessQ, you must sign in using a valid Google account. You are responsible for:

• Maintaining the security of your Google account credentials.
• All activity that occurs under your WaitLessQ account.
• Ensuring that the information you provide (business name, country, etc.) is accurate and up to date.
• Notifying us immediately at info@pazhanam.com if you suspect unauthorised use of your account.

You may not create an account on behalf of someone else without their explicit authorisation, or use the Service for any unlawful purpose.

4. Free Plan and Premium Plan

4.1 Free Plan

The Free Plan is available to all registered users at no cost. It includes:

• All core queue management features including token number system, live QR queue tracking, table management, staff PIN login, digital menu display, and daily analytics.
• A limit of 10 customers per day per account. Once this limit is reached, new customers cannot be added to the queue until the next calendar day (midnight in your local time zone).

We reserve the right to modify the Free Plan limits at any time with reasonable notice.

4.2 Premium Plan

The Premium Plan removes the daily customer limit and provides access to advanced features. Premium pricing and terms are communicated directly and may vary by region. Contact us at info@pazhanam.com for current pricing.

• Premium is activated manually by our team after confirmation of payment.
• No refunds are provided after the Premium period has begun, unless required by applicable law.
• We reserve the right to change Premium pricing with 30 days' notice.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Service to collect or process sensitive personal data (such as health records, payment card numbers, or government ID numbers) through the queue entry fields.
• Enter false, misleading, or defamatory information about customers or staff.
• Attempt to gain unauthorised access to our systems, servers, or databases.
• Reverse-engineer, decompile, or disassemble the app.
• Use the Service to send spam, phishing messages, or unsolicited communications.
• Violate any applicable local, national, or international law or regulation.
• Impersonate another business, person, or entity.
• Share your account credentials with unauthorised third parties (use the staff PIN feature for staff access instead).

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Customer Data Responsibility

You are the data controller for customer information you enter into WaitLessQ (names, party sizes, contact numbers). You are responsible for:

• Obtaining any necessary consents from your customers for recording their personal information.
• Complying with applicable data protection laws in your jurisdiction (including India's Digital Personal Data Protection Act, GDPR for EEA users, and equivalent laws).
• Informing customers that their information is processed by WaitLessQ, which stores data on Google Firebase servers.

We act as a data processor on your behalf for customer data. Our data processing practices are described in our Privacy Policy.

7. Intellectual Property

All content, design, code, trademarks, logos, and materials in the WaitLessQ application are owned by or licensed to Pazhanam Technologies Pvt Ltd. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Your data is yours. You retain full ownership of all business data you enter into the Service — your menu, queue records, staff details, and table configurations. We do not claim any ownership over your business data.

8. Availability and Uptime

We strive to keep WaitLessQ available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Planned maintenance (we will try to notify users in advance).
• Unplanned outages at Google Firebase or other infrastructure providers.
• Force majeure events beyond our reasonable control.

We are not liable for any losses arising from downtime or unavailability of the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times, or that defects will be corrected promptly.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Pazhanam Technologies Pvt Ltd and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of revenue, customers, data, or business arising from your use of or inability to use the Service.
• Any damages resulting from unauthorised access to your account.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or INR 1,000 if you are on the Free Plan).

11. Indemnification

You agree to indemnify, defend, and hold harmless Pazhanam Technologies Pvt Ltd from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Third-Party Services

WaitLessQ uses Google Firebase for data storage and authentication, and Google Play for Android app distribution. Your use of these services is subject to Google's own Terms of Service and Privacy Policy. We are not responsible for the practices of these third-party services.

13. Termination

You may stop using the Service at any time. To delete your account and all associated data, contact us at info@pazhanam.com.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violations of these Terms. Upon termination, your right to use the Service immediately ceases. We will delete your data within 30 days of account termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at info@pazhanam.com.

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will notify you via the email associated with your account.
